Terms and Conditions of Sale and Delivery for online distribution

Burton Sportartikel GmbH exclusively concludes contracts under the following terms and conditions of sale and delivery.

Terms and conditions of delivery

Orders placed via the European Website (www.burton.com) shall solely be delivered into the Member States of the European Union as well as to Switzerland. Should you wish a delivery to North America, please visit our American Website ( www.burton.com).

Delivery mode

All goods are directly delivered to the address indicated as delivery address in the course of the ordering process by parcel service.


Delivery date

The delivery time is between 2 to 8 working days. Saturdays do not count as working days.

You will receive an order confirmation via email upon receipt of your order by us.


Delivery times are from Monday to Friday (holidays excluded) from 8:00 a.m. to 3 p.m. If you are not present at the time of delivery the parcel courier should leave a card with contact and redelivery information. Please arrange redelivery directly with the courier.


Please note: Should the parcel service provider not be able to deliver the ordered goods at the delivery address indicated by you - despite of several delivery attempts - the ordered goods are sent back to our logistic centre.


The Burton Sportartikel GmbH will then take back the order and issue a refund directly to the credit/debit card used for purchase.


Burton Sportartikel GmbH is in no case obliged to reimburse the freight costs in cases such as this.


Freight costs

Burton Sportartikel GmbH offers a flat rate postage price - independent of the value of goods.


EUR 6.90 per / CHF 12.90 / GBP 5.90, unless stated otherwise on the website during the checkout process.


Payment methods

Goods ordered via the European Website (www.burton.com) can be paid by credit card. We currently accept Visa/Eurocard/Mastercard as well as Paypal.


Prices

All prices are either given in EUR, GBP (Great Britain) or CHF (Switzerland). The prices stated contain value added tax, however no freight costs. The Burton Sportartikel GmbH shall not be held liable for any currency exchange rates or changes thereof.


Withdrawal from the contract / Returns

You have the right to withdraw from the contract and return your goods within Seven (7) business days upon receipt of your order; Saturdays do not however count as business days. To comply the goods must be posted within Seven (7) business days -

Returned goods have to be sent back unworn, un-ridden and undamaged in original packaging and with the labels still attached to them. Burton Sportartikel GmbH shall reimburse payments made by you (including the freight costs) upon receipt of the goods ONLY if the goods are returned within the Seven (7) business day right to return period and the value of the goods is over EUR40.


A shipping receipt or invoice must be sent to ecom@burton.at with a brief outline of order & bank details (order number / surname / Account number / Sort code) for us to be able to reimburse any shipping costs.


Due to the high handling costs, it is not possible for us to refund return postage costs for orders with a goods value of less than EUR 40.00 (freight costs not included). Customers wishing to return orders with a goods value of less than EUR 40.00 must pay for return delivery.


Should the right to withdraw from the contract expire (longer than Seven (7) business days) the ordered goods including the labels and original packaging have to be immediately and at one’s own expense sent back to the Burton Sportartikel GmbH (Loxxess, ECOM Returns, Steinauer Weg 7 91589 Aurach/Germany).


Complaints

Please send an email to ecom@burton.at stating the reason for your complaint, your order number as well as a list of reasons or issues you want to complain about. We will respond as quickly as possible and inform you on the following procedure.


General provisions / Deviations from these Terms and Conditions

It is possible that our product information (available at www.burton.com) contain provisions deviating from these terms and conditions of sale and delivery. Such deviations from these terms and conditions of sale and delivery are prominently indicated in our product information. By clicking on the button;I have read and understood the terms and conditions of sale and delivery and accept them, you confirm having taken notice of any deviating provisions.


Personal data

When ordering goods via the website www.burton.com, you make your personal data (e.g. name, address) available to the Burton Sportartikel GmbH. The Burton Sportatikel GmbH shall use this data for the following purposes:


- Execution of your order, including the transfer of certain personal data (name, address) to the parcel service provider for delivery purposes;

- Verification of your creditworthiness as a client;

- Advertising purposes (e.g. sending of catalogues)

- Email newsletters

On your demand, the Burton Sportartikel GmbH shall

Product information

Burton Sportartikel GmbH reserves the right to make the occasional typing error (we are only human like you) and other errors in our product information and on our website www.burton.com. The reproduction of colours in the depiction of the products does not always match at 100% the actual colours of the depicted products.


Terms and conditions of delivery

Burton Sportartikel GmbH is entitled to change the prices indicated on the site www.burton.com. The respective price indicated at the time of completion of the order process, shall be the price agreed for the ordered goods.


Changes in the assortment

Burton Sportartikel has the right to change the assortment of goods available on the website www.burton.com and to remove articles from the assortment of goods. It is possible that at times goods are available on the site that are actually not available in the warehouse or have sold out….in circumstances like this you shall be notified and an alternative product or refund found/made.


Terms and conditions of delivery

All contracts concluded between you and Burton Sportartikel GmbH are on the basis of these Terms and Conditions of Sale and Delivery and all claims resulting from and arising out of the existence and non-existence of these contracts shall be governed by substantive Austrian law with the exception of the Austrian private international law and the UN-Convention on the International Sale of Goods (UNCITRAL).
