ELIGIBILITY
This sweepstakes is only open to legal residents of the continental United States (excluding RI) and Canada (excluding Quebec). It is subject to all federal, state, and local laws and regulations. Employees of Burton and Gore and their respective subsidiaries, retailers, distributors, affiliates and their agents, advertising, promotion and production agencies and their immediate family members (parents, children, siblings and spouses of children or siblings) and household members are not eligible. Participants under the age of 18 must receive permission from a parent or guardian to enter.
By attempting to submit an entry, you release Burton, Gore and their subsidiaries, and their respective officers, directors, employees, representatives, retailers, distributors, affiliates and their agents, advertising, promotion and production agencies from all losses and any and all liability for any loss, harm, damages, costs or expenses, rights, claims, and actions of any kind in connection with the sweepstakes, including without limitation, property damage, criminal prosecution, personal injury and/or death, arising out of your participation in this sweepstakes.
Failure to comply with all rules and regulations associated with the “Gore-Tex Glove” sweepstakes could result in disqualification from the “Gore-Tex Glove” sweepstakes.
ENTRY VIA THE INTERNET ONLY
Please complete the registration form located at www.burton.com. This is the only method of entry. Neither Burton nor Gore are responsible for any lost, late, delayed, illegible, incomplete, mutilated, or misdirected entries. Neither Burton nor Gore are responsible for incorrect or inaccurate entry information caused by any technical or human error which may occur in the processing of the entries in this sweepstakes.
ALL SUBMISSIONS
Any registration forms submitted during this sweepstakes are considered public domain. Burton and Gore reserve the right to, in their sole discretion, cancel, modify or suspend this sweepstakes. Potentially offensive entries to the “Gore-Tex Glove Sweepstakes” will not be considered. You hereby give Burton and Gore the absolute right to use your response for any lawful purpose whatsoever in any and all forms of media. You hereby waive any right that you may have to inspect or approve the finished product(s), if any, that use your entry and any compensation resulting from the entry you submit.
All entries are subject to verification. Any entry that is tampered with, counterfeited, illegible, mutilated, reproduced, contains printing or other errors, obtained where prohibited or not obtained legitimately, is null and void. In the event that production, seeding, printing or other errors cause more than the stated number of prizes of any category to be claimed, Burton and Gore reserve the right to suspend delivery of prizes, without prior notice.
SUBMISSION REVIEW
All entries must be received by 11:59 PM EDT on each Friday that the sweepstakes is in effect.
On or about each Monday that the sweepstakes is in effect, three (3) winners will be selected in a random drawing from eligible entries received during the entry period. The winners will be notified by email or Federal Express on or about each Wednesday that the sweepstakes is in effect. If a Prize Notification Letter or a Prize is returned as undeliverable, the Prize will be forfeited and awarded to an alternate winner in a random drawing from among all remaining eligible entries.
PRIZE AND ITS APPROXIMATE RETAIL VALUE ("ARV")
There are forty-eight (48) prizes, each consisting of one (1) pair of Burton gloves of Burton’s sole discretion. Approximate retail value of prize is USD Fifty and 00/100 Dollars ($50.00).
Each winner will be solely responsible for all federal, state and local taxes, license, fees or other costs. Burton will ship prize to the winner via Federal Express at Burton’s expense. Neither Burton nor Gore are responsible for delays in delivery of any prize. The winner shall bear all risk of loss to prize after it has been received. Burton and Transworld are under no obligation to provide the winner with any other substitute prize. In the event a winner is or becomes ineligible, the prize may be forfeited and awarded to an alternate winner in a random drawing from among all remaining eligible entries.
Prize is non-transferable; no substitutions, exchanges, or product redemptions. Each winner will be required to execute and return an Affidavit of Eligibility and Liability Release within fourteen (14) days of notification or prize will be forfeited and an alternate winner selected.
By participating in this sweepstakes, entrants agree to abide by and be bound by these Official Rules. Participants agree that this sweepstakes are exclusively governed by the laws of the State of Vermont. Any claims arising out of the sweepstakes shall be governed by Vermont law and may be brought only in a federal or state court in Vermont. If any provisions of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
By accepting a prize, each winner grants to Burton and Gore the right to use his/her name, likeness, hometown and biographical information, for any lawful purpose, without further permission or compensation, except where prohibited by law.
